Is Cash Discounting The Same as Surcharging?

The terms cash discounting, dual pricing, and surcharging are often confused in payment processing discussions. Understanding the differences is crucial for compliance and customer communication.


Key Definitions

Cash Discount

Businesses build credit card costs into regular pricing with one displayed price. A cash discount is calculated at the register and is legal nationwide.

Dual Pricing

Both cash and card prices are clearly displayed on items. This approach is compliant in all 50 states.

Non-Cash Adjustment

This involves posting signs stating listed prices include cash discounts, with adjustments added for card payments. This approach is NOT COMPLIANT and is considered a surcharge in many states.

Surcharging

Fees added when non-PIN debit payment methods are used, capped at 3% by card networks. Surcharging is legal in 46 states as of April 2024.


Legal History

Prior to 2013, surcharging was restricted nationwide. A merchant challenge in 2015 began shifting policy, with New York settling in January 2019, opening the practice to all states except Connecticut, Maine, Massachusetts, and New York (with restrictions).


Consumer Response

Most consumers have not had strong objections to these pricing practices when implemented transparently. The key is clear communication-customers appreciate knowing the full cost upfront rather than being surprised at checkout.
