Auto Repair Dual Pricing Software Provides Solution for NY Surcharge Law

By Elisabeth G

Overview

Rate Remover Software has launched a solution addressing New York's 2023 law that prohibits the "Non-Cash Adjustment" program. The company created dual pricing invoicing software to help businesses comply with state regulations.

The Legal Background

In December 2023, New York Governor Kathy Hochul signed legislation clarifying earlier settlement terms from a 2019 merchant lawsuit. The law stemmed from a long-running case that had permitted merchants to add surcharges for card payments to offset processing costs.

The settlement required that "both card price and cash price, or the higher card price only, must be displayed." Many auto repair shops inadvertently violated this requirement by adding line-item surcharges through standard invoicing software.

The Problem

Traditional repair shop software lacks dual pricing capabilities. Owners attempting compliance through simple surcharge add-ons created illegal invoicing structures. The restriction applies across multiple states: New York, Massachusetts, Connecticut, and California.

The Solution

Founded by Scott Gibbens, Rate Remover Software launched in February 2024 with an invoice and estimating program displaying both cash and card prices. The software offers:

  • Single price with card fees built in automatically
  • Cash discount option displayed clearly
  • Dual Pricing – both card and cash price listed
  • Sales and sales tax tracking
  • QuickBooks integration

Warning

Businesses continuing card payment surcharges risk state fines and card brand penalties. If you're currently using a non-compliant system, contact us to learn how Rate Remover can help you transition to a compliant dual pricing model.
